1. Preamble
The use of the Website including web browsing (web crawling), its caching services as well as any other services provided by the Website, presupposes the unreserved acceptance of the terms of use described here and constitutes acceptance of these terms.
2. Definitions
Institution is each member of the Research Infrastructure Network for the Humanities (DYAS).
Content is defined as all data, software, databases, metadata, as well as any other intellectual work that may be the subject of copyright according to Law 2121/1993, as applicable, regardless of whether the protection period has expired or the use falls under copyright exceptions.
Use is the utilization of the services of the Website in any way.
User is anyone who uses the Website.
Service is defined herein as the processing of functions based on digital technologies that serve the needs of the user.
Registered users are users who register for the services provided by the Institution.
3. Legal Use
The Website must be used exclusively for legal purposes, in accordance with the terms herein, and in a way that does not limit or hinder their use by third parties. The user of the Website must not perform actions or omissions that can cause their malfunction and negatively affect or endanger the provision of services to users.
4. Intellectual Property and Licences
The content of the Website for which the Institution has the necessary copyright or licence – unless otherwise expressly stated, especially with regard to content over which third parties have rights – is made available through the services of the Website to users exclusively and solely under the terms of the Creative Commons Attribution-NonCommercial-ShareAlike Licence version 4.0 or later.
The Computer software used for the development and operation of the Website is Free Software/Open Source Software and may be made available under licences that comply with the definitions of the Free Software Foundation and the Open Source Initiative regarding licences that are open and free.
The specific licence under which the content and software is made available is specifically identified as metadata available with the content or software.
The content of the Website can be made available either through a graphical interface that allows the end user to view, edit and upload the content, or through Internet Services (web services) and Application Programming Interfaces (APIs), in which other information systems have access in accordance with these terms of use and may upload data or metadata under the licences specified above.
Any other work protected by copyright law and available under licences other than the above must be expressly and specifically identified as such.
5. Knowledge Disclosure Policy
The Institution in its effort to enrich and expand the knowledge commons undertakes to use Free/Open Technologies, Software, Data and Standards on its Websites and to provide all content (including data and metadata) with licences that balance the objectives of the end/further user and the Institution.
This means that all layers of the stack that make up the services provided through the Websites follow common principles of Openness and Free use and reuse.
In particular, as long as there are no third-party rights that cannot be cleared:
(a) The Standards used are Open and Free.
(b) The formats used are Open and Free.
(c) The Software used is Free Software/ Open Source Software.
(d) The Website is an Open Access site.
(e) Every effort is made to make content available under Creative Commons licences.
(f) Every effort is made to make the data available in accordance with the Open Data Definition.
(g) Every effort is made to ensure that the services provided by the Website follow the Open Service Definition.
6. Fair Use Terms Policy
The Institution, in its effort to promote transparency and openness and to defend the interests of the end user, undertakes to use fair terms and to notify its users in the most convenient way of any change in the terms of use under which its Websites and the services provided by them are provided.
7. Disclosure and removal of illegally posted content policy
If a copyright holder finds in the Institution’s repository illegally published material, which a) is not covered by any restriction or other exception according to Greek copyright law and b) for the use of which the relevant permission has not been given, the above beneficiary is requested to contact the Institution in writing via e-mail at [email protected], stating the following:
– Their contact details.
– The complete bibliographic data or, if these do not exist, the reference data of the material.
– The URL where the material is located (e.g. the URL of the record).
– Evidence confirming that they are the beneficiary and/or a statement confirming that they are the beneficiary of the intellectual property or their legal representative.
Upon receipt of the complaint, the process of warning and removal of illegally published content is initiated, as follows:
i. The Institution confirms that it has received the complaint by email or post and makes a first assessment of its validity and reliability.
ii. Upon receipt of a valid complaint, the material is temporarily withdrawn from the Institution’s repository until a consensual solution is found.
iii. The complainant and the Institution or any other individual or legal entity who submitted the material are required to resolve the issue of the complaint by common consent and in a short period of time by adopting one of the following solutions:
– The material is re-published in the same form as before.
– The material is republished with changes.
– The material is permanently removed from the directory of the Website.
– As long as the Institution and the complainant are unable to reach a mutually acceptable resolution of the matter, the material remains unavailable through the directory until an agreement is reached on the matter.
8. Disclaimer
The Institution provides the content (e.g. information, names, photos, images, data, etc.) and the services available through its Website “AS IS”. Under no circumstances shall the Institution be liable for any claims of a legal, civil or criminal nature nor for any possible damage (positive, special or consequential) of the user of this Website.
The Website may contain references (links) to third party websites for the sole purpose of informing the user. Reference to links belonging to third party websites does not constitute an adoption of their views and actions or acceptance of the content they express, publish or post. The third parties – operators of the websites responsible under the law – are solely responsible for the content of their websites or for any damage that may result from their use, when the user of the Website gains access to them. The users accept that by visiting third-party websites, they leave the Website and are subject to their terms of use.
The Institution bears no responsibility in relation to information provided by third parties and available through the services of the Website.
The Institution makes every effort for the good operation of its network, although it does not guarantee that the operations of its servers will be uninterrupted or error-free, free of viruses, malware or other similar elements.
The Institution is not responsible, under any circumstances, for any form of damage suffered by the user of the websites, services, options and contents of the Website. It also does not guarantee that each website related to its Website, or the servers through which each relevant service is made available to the user/visitor do not contain “viruses” or other malicious software. Furthermore, it does not guarantee the correctness, completeness or availability of the content of the websites, services, options or the results from their use.
9. Jurisdiction, Effect and Modifications
The terms and conditions of use of this Website as well as any modification or change thereof are governed and supplemented by Greek and E.C. law and the relevant international treaties. The Greek Courts are defined as the courts for resolving any disputes arising from this document. Any provision of the above terms that is found to be contrary to the above legal framework or becomes invalid, automatically ceases to be valid and is removed from it, without in any way affecting the validity of the other terms.
The terms and conditions of use of this Website constitute the overall agreement between the Institution and the user/visitor of its websites and services and binds them only. No modification of these terms of use shall be considered or made a part of this agreement unless expressed in writing and incorporated into these terms of use. Unless otherwise specified, upon announcement on this website the above terms of use are immediately effective in their entirety.
The curator of the Website unilaterally reserves the right to modify, add, change the content or the services of the Website, as well as the conditions of use thereof, whenever they deem this necessary, with the obligation of prior notification to the registered members who have given permission to the Institution to communicate with them for this purpose. Otherwise, the communication is made by announcement on the Website and in accordance with the applicable legislation.
